What is Pre-Trial Diversion/Intervention
The Pre-Trial Diversion (PTD) program in Florida is an alternative to traditional criminal prosecution for certain eligible individuals who are charged with non-violent offenses. It is designed to divert individuals away from the formal court process and provide an opportunity for rehabilitation and resolution without a criminal conviction.
The program is typically available to first-time offenders or those with minimal criminal records charged with non-violent offenses. The eligibility criteria may vary by jurisdiction and the specific nature of the offense.
To participate in the PTD program, individuals must be offered the program by the state attorney’s office. This usually involves submitting an application provided by the State Attorney and undergoing a screening process.
If accepted into the program, participants are required to comply with certain conditions and complete specific tasks. These may include classroom instruction, community service, counseling, drug or alcohol treatment programs. This progam is adminstrated through the probation office but you would not be on probation.
The duration of the program can vary but typically lasts between 6 months to 2 years, depending on the nature of the offense and the individual’s progress in meeting the program requirements. When the person participating is diligent about the requirements the process could go faster.
Successful completion of the Pre-Trial Diversion program results in the dismissal of the criminal charges. This means that the individual will not have a criminal record related to the specific offense.
Failure to Complete
If a participant fails to comply with the program requirements, their case will be returned to the traditional court process, and they will face prosecution for the original charges.
Participating in the Pre-Trial Diversion program offers several benefits, including the opportunity to avoid a criminal conviction, with an almost guaranteed case dismissal, and the ability to maintain a clean record.
